1. Acceptance and eligibility

These Terms & Conditions (“Terms”) govern access to and use of Drawfect Bookings (“Drawfect Bookings,” “we,” “us,” or “our”), including our website, creator dashboard, public profiles, booking forms, embeds, and related services (collectively, the “Services”). By creating an account, publishing a profile, submitting an inquiry, or otherwise using the Services, you agree to these Terms and our Privacy Policy.

You must be legally capable of entering into a binding agreement. Creator accounts are intended for adults and businesses. If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Platform role

Drawfect Bookings is a booking and business-management platform for Live Event Creators. We provide software to present services, pricing, and availability; receive booking inquiries; and manage related workflows. Unless we expressly state otherwise in writing, Drawfect Bookings is not the direct service provider for every event, is not a party to agreements between creators and customers, does not employ creators, and does not guarantee that any inquiry will result in a booked event.

Creators are independent businesses responsible for their own services, licensing, insurance, taxes, and customer relationships.

3. Accounts and user responsibilities

You agree to provide accurate information and to keep login credentials confidential. You are responsible for activity under your account. Notify us promptly at contact@drawfect.com if you suspect unauthorized access.

Creators are responsible for the accuracy of service descriptions, pricing, availability, and for performing the services they confirm. Customers are responsible for providing accurate event and booking information. Use of the Services must be authorized and lawful.

4. Booking inquiries and agreements

Customers may browse public profiles and submit booking inquiries. A submitted inquiry is a request for the creator to consider an engagement; it does not automatically constitute a confirmed booking. Approval, payment steps, confirmation, or other workflow actions may be required before a booking is confirmed.

Creator-specific booking terms, pricing, cancellation rules, setup requirements, and service details may apply and may supplement these Terms. The terms displayed for a specific creator or booking control the commercial details of that engagement between the creator and the customer. Tentative holds and confirmation workflows on the platform are tools to manage scheduling; they do not replace the creator–customer agreement for the event itself.

5. Payments

Creators may configure payment preferences, deposits, and related messaging. When Square (or another integrated payment provider) is enabled, card processing is performed by that provider. Cards may be saved with the provider for later charges according to the creator’s payment settings (for example, charging on approval). Drawfect Bookings does not store complete card numbers on its servers.

Drawfect Bookings does not provide banking services and does not hold customer funds as a bank or escrow. Refunds, chargebacks, and payment disputes are handled according to the payment provider’s tools and the creator’s policies. Taxes on creator services are the responsibility of the creator and/or customer as required by law.

6. Communications and electronic notices

Users may receive service-related email and platform communications connected to their accounts, inquiries, and bookings. These notices are part of operating the Services.

7. SMS Terms

Customers may voluntarily opt in to receive text messages through the booking or inquiry web form by checking a separate optional consent checkbox. Messages may include booking-request confirmations, approval or decline notices, scheduling updates, appointment reminders, availability notices, customer support related to a booking, and other service-related booking communications. Message frequency varies based on booking activity. Message and data rates may apply.

Consent to receive SMS messages is not a condition of purchasing a service, submitting a booking inquiry, creating an account, or otherwise using the platform. Declining SMS consent does not prevent the customer from completing the booking inquiry through other available communication methods (such as email).

Carriers are not liable for delayed or undelivered messages. Opt-out requests may take a reasonable period to process, and a final confirmation message may be sent. Our Privacy Policy explains how mobile numbers and messaging consent are handled. These SMS Terms cover service-related booking messages only; they do not authorize promotional or marketing texts unless a separate campaign and consent are clearly provided.

8. Calendar integrations

Optional calendar integrations (including Google Calendar and Apple Calendar) help display busy times and available booking windows and may sync confirmed bookings to a creator-selected calendar. Creators authorize access solely as needed for those features and remain responsible for accurate permissions, schedules, and any conflicts.

9. Prohibited conduct

You agree not to:

• Engage in illegal activity;
• Commit fraud or misrepresent your identity or business;
• Harass other users;
• Attempt unauthorized access to accounts, systems, or data;
• Distribute malware or other harmful code;
• Scrape, harvest, or abuse the system except as allowed by ordinary use of public pages or with our written permission;
• Violate intellectual-property or privacy rights;
• Interfere with platform operation or impose unreasonable load on our infrastructure.

10. Intellectual property

Drawfect Bookings and its logos, software, design, and documentation are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services as provided, solely for their intended purpose.

You retain ownership of content you upload, including creators’ original artwork and customer-uploaded files. You grant Drawfect Bookings a limited, worldwide, non-exclusive license to host, store, display, reproduce, and distribute that content only as needed to operate the Services (including public profiles, browse listings, embeds, and social previews when you publish content). This license ends when you remove the content from the Services, except for reasonable residual copies in backups or caches.

11. Third-party services

The Services may use or link to third-party services (payment processors, calendar providers, email and messaging infrastructure, hosting, authentication, and similar). Those services may have separate terms and privacy policies. We are not responsible for third-party services outside our control.

12. Availability and modifications

Features may change over time. We do not guarantee uninterrupted or error-free availability of the Services.

13. Disclaimers and limitation of liability

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties that the Services will be uninterrupted, error-free, or meet every expectation regarding inquiries, availability displays, or payments.

To the maximum extent permitted by law, Drawfect Bookings will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to the Services or these Terms. Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amounts you paid to Drawfect Bookings for the Services in the twelve (12) months before the claim or (b) one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

14. Termination

You may stop using the Services at any time and may request account closure by contacting contact@drawfect.com. We may suspend or terminate access for material violations of these Terms, fraud, abuse, security threats, or legal requirements, or if we discontinue the Services.

15. Changes to these Terms

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
